Welcome to Dugout Pros (the “Site” or “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website https://dugoutpros.com/, including any content, functionality, and services offered on or through the Site (collectively, the “Services”), and all purchases of products from us.

By accessing, browsing, or using the Site or Services, or by placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase from us.

We are a Connecticut-based business located in Harwinton, CT, selling used/pre-owned baseball bats and related gear.

1. Eligibility

You must be at least 18 years old or have parental/guardian consent to use the Site and make purchases. By using the Site, you represent that you meet these requirements.

2. Products and Descriptions

•  All products are used, pre-owned, or second-hand baseball bats (and eventually other baseball gear).

•  We describe items based on our reasonable inspection, including size (e.g., length/weight like 31”/28oz), certification (e.g., BBCOR, USSSA), construction (e.g., one-piece alloy), and visible condition.

•  Photos are provided for reference and show the actual item for sale. Cosmetic wear, scratches, dents, or other signs of prior use are common and expected—review photos carefully.

•  Descriptions, certifications, and performance claims (e.g., “hot pop”) are not guarantees; used bats may have reduced performance due to prior use.

•  We reserve the right to correct errors in descriptions or pricing.

3. “As Is” Sale – No Warranties

ALL PRODUCTS ARE SOLD “AS IS, WHERE IS, WITH ALL FAULTS”.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that any bat or gear will meet league standards (e.g., BBCOR/USSSA after sale), perform as new, be free from hidden defects, or be safe from breakage/injury due to prior use or misuse.

Buyers assume all risk of inspection, condition, and suitability.

4. Pricing, Payments, and Sales Tax

•  All prices are in USD and subject to change without notice.

•  We accept: Mastercard, Visa, American Express, Discover, Diners Club, JCB.

•  Connecticut sales tax (currently 6.35%) will be added to orders shipped to Connecticut addresses or where required by law. We may collect tax in other states if we have nexus.

•  You are responsible for any additional duties, taxes, or fees for international orders.

5. Orders, Shipping, and Delivery

•  Orders are subject to acceptance; we may cancel or refuse any order.

•  Shipping is via USPS/UPS/FedEx, FedEx Ground; costs calculated at checkout.

•  Risk of loss passes to you upon shipment/handover to carrier.

•  Delivery times are estimates only—no liability for delays.

•  Local pickup may be available—contact us.

6. Returns, Refunds, and Cancellations

In general:

•  No returns or refunds for “change of mind,” personal preference, or performance expectations on used items.

•  Returns accepted only if item is materially not as described (e.g., wrong size/model, undisclosed major damage). Report within [e.g., 7–14 days] of receipt with photos/proof.

•  Buyer pays return shipping unless we erred. Refunds (if approved) exclude original shipping.

7. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the purchase price of the product. We are not liable for indirect, incidental, consequential, special, or punitive damages (e.g., lost games, injuries, or other losses from use/misuse of products).

8. Intellectual Property

All content on the Site (photos, text, logos) is our property or licensed to us. You may not copy, reproduce, or use without permission.

9. Prohibited Conduct

You agree not to: misuse the Site, attempt fraud, post illegal/harmful content (if reviews enabled), or violate laws.

10. Termination

We may suspend or terminate your access/orders for violations of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Connecticut.

12. Changes to Terms

We may update these Terms at any time; continued use constitutes acceptance.
